In these terms, “Practitioner/Coach” refers to Joyce Wouters-Brust, trading as Joyce’s Hearth. “Client” refers to the individual or business purchasing or receiving services from Joyce’s Hearth.
These terms apply to all services provided by the Practitioner/Coach to the Client, unless otherwise agreed in writing.
2. Applicability
These terms apply to all services offered by Joyce’s Hearth, unless otherwise agreed in writing.
Any individual proposal, programme agreement, booking confirmation or event-specific terms may contain additional arrangements. Where an individual agreement differs from these general terms, the individual agreement takes precedence for those specific arrangements.
3. Nature of the services
Joyce’s Hearth offers personal development, coaching, mentoring and holistic services to both private individuals and business clients.
Depending on the service agreed, these may include:
Online and in-person coaching, mentoring and personal development.
Online and in-person energy work.
In person body-based practices and sessions involving physical touch.
Online and in-person breathwork, systemic work, intuitive exploration and reflective practices.
Group sessions, workshops and other facilitated experiences.
The Practitioner/Coach works intuitively and may choose or combine different approaches during a session, based on professional judgement and what is considered appropriate at the time.
The services are intended to support self-awareness, personal development, self-connection and overall wellbeing. No particular outcome or result is guaranteed.
4. Client responsibility and participation
The Client remains responsible for their own choices, decisions, actions and wellbeing throughout the engagement.
The Client is invited to participate at their own pace. The Client may ask questions, decline an exercise, take a break or stop a session at any time.
The Client understands that personal development work can bring up emotions, memories or reflections. The Client is responsible for deciding what feels appropriate and for seeking additional support where needed.
For group sessions and workshops, the Client is also expected to respect the privacy, personal boundaries and experiences of other participants.
5. Medical and psychological boundaries
The services provided by Joyce’s Hearth are not a substitute for medical care, psychological treatment, psychotherapy, psychiatric care or other regulated healthcare services.
The Practitioner/Coach does not diagnose medical or psychological conditions, prescribe medication or provide medical advice.
The Client agrees to inform the Practitioner/Coach of any relevant health circumstances, including physical or mental health conditions, medication, pregnancy or other factors that may affect participation.
If the Practitioner/Coach believes that a particular activity or session may not be appropriate for the Client, the Practitioner/Coach reserves the right to adapt, postpone or decline that activity and, where appropriate, recommend that the Client seek advice from a qualified healthcare professional.
6. Energy work and physical contact
Some sessions may involve energy work, body-based practices or physical touch.
Before any physical contact takes place, the Practitioner/Coach will explain what is involved and ask for the Client's consent. The Client may decline physical contact or withdraw consent at any point, without needing to provide a reason.
Remote energy work is offered as part of certain services. The Client is free to decline this approach or request that a different method be used.
No medical claims are made in relation to energy work or other holistic practices.
7. Appointments, groups and communication
Appointments may take place online or in person, depending on the service agreed.
For online sessions, the Client is responsible for arranging a private and suitable environment, a stable internet connection and any equipment needed to participate.
The Client is expected to arrive on time. If the Client arrives late, the session may still need to finish at the originally scheduled time.
Group sessions and workshops may have additional booking, participation or cancellation conditions. These will be communicated before booking.
WhatsApp or other between-session communication is only included where this has been agreed as part of the individual arrangement. It is intended for reasonable support and communication, not continuous or emergency availability.
8. Fees, invoicing and payment
The applicable fees will be communicated before the Client books or enters into an agreement.
For longer programmes or individual arrangements, the fee and payment schedule will be confirmed in writing.
All fees are subject to VAT where applicable. Any VAT due will be charged at the applicable rate in accordance with Irish and relevant international VAT regulations.
Unless otherwise agreed, invoices are payable within 14 days of the invoice date.
For business Clients, any agreed business-specific payment arrangements, purchase order requirements or invoicing details should be confirmed before the work begins.
Where payment is overdue, the Practitioner/Coach reserves the right to pause further sessions or services until payment has been received, subject to applicable law.
9. Cancellation and rescheduling
The Client may reschedule or cancel an individual appointment without charge by giving at least 48 hours’ notice.
For cancellations made less than 48 hours before the appointment, or in the event of a no-show, the Practitioner/Coach reserves the right to charge the full session fee.
For group sessions, workshops or events, any specific cancellation deadlines or refund arrangements will be communicated at the time of booking.
The Practitioner/Coach understands that unexpected circumstances can arise. Illness, emergencies and exceptional situations will be considered with reasonable flexibility.
If the Practitioner/Coach needs to cancel an appointment or event, an alternative date will be offered or, where appropriate, a refund will be provided for the cancelled service.
Any statutory cancellation or withdrawal rights the Client may have remain unaffected by this section.
10. Longer programmes and ending an agreement
The duration, structure, frequency of sessions and fees for longer programmes will be confirmed in an individual written agreement.
If either party wishes to end an ongoing programme early, this should be communicated in writing.
Where a programme ends before its agreed completion, the Practitioner/Coach will calculate any outstanding amount fairly, taking into account the services already provided and any applicable contractual or statutory rights. Any refundable prepaid amount will be returned in accordance with applicable law.
The Practitioner/Coach reserves the right to end or pause an engagement where there are repeated boundary violations, inappropriate or unsafe behaviour, non-payment, or where continuing the work is considered no longer appropriate.
11. Right of withdrawal for consumers
If the Client is a consumer entering into a contract online, by email, by telephone or through another distance-selling method, the Client may have a statutory right to withdraw from the contract within 14 days of entering into it.
If the Client asks the Practitioner/Coach to begin providing services during this 14-day withdrawal period, the Client may be required to pay a proportionate amount for the services already provided if the Client subsequently withdraws.
Where a service has been fully performed within the withdrawal period, the Client's right to withdraw may end if the Client gave prior express consent for the service to begin and acknowledged that the right to withdraw would be lost once the service had been fully performed.
Where applicable, the Practitioner/Coach will provide the information and model withdrawal form required by consumer law.
Nothing in these terms is intended to limit any mandatory consumer rights the Client may have under applicable law.
12. Confidentiality and recording
The Practitioner/Coach treats the information shared by the Client during the engagement with care and discretion.
The Practitioner/Coach will not share personal information about the Client with third parties unless the Client has given permission, disclosure is required by law, or another lawful basis applies.
Sessions may not be recorded, photographed or shared by either party without the prior agreement of the other.
For group sessions, the Practitioner/Coach asks all participants to respect the confidentiality of what other participants share. However, the Practitioner/Coach cannot guarantee the actions or confidentiality of other participants.
The Practitioner/Coach will not use the Client's name, identifiable details, testimonials or personal experiences for marketing, educational or promotional purposes without separate and explicit consent from the Client.
13. Privacy and personal data
The Client's personal data is handled in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).
Further information about how the Practitioner/Coach collects, uses, stores and protects personal data is provided in the separate Privacy Policy of Joyce’s Hearth.
Where particularly sensitive information, such as health-related information, is involved, the Practitioner/Coach will only process it where an appropriate legal basis and any required additional conditions are in place.
The Client has rights in relation to their personal data, as explained in the Privacy Policy.
14. Liability
The Practitioner/Coach will provide the services with reasonable care and skill.
The Client acknowledges that personal development, coaching and holistic work involve individual experiences and that outcomes cannot be guaranteed.
To the extent permitted by law, the Practitioner/Coach is not liable for indirect or consequential losses arising from the Client's participation in the services.
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, fraud, intentional misconduct or other liability that cannot legally be excluded.
The professional insurance held by the Practitioner/Coach applies to the activities and services covered by the relevant policy.
15. Intellectual property
Any materials, exercises, written content, recordings or resources provided by Joyce’s Hearth remain the intellectual property of the Practitioner/Coach unless otherwise agreed in writing.
The Client may use these materials for personal use or, where relevant, for the internal purposes of their business. The Client may not reproduce, distribute, publish, sell or share them externally or commercially without prior written permission from the Practitioner/Coach.
16. Circumstances beyond reasonable control
The Practitioner/Coach is not responsible for delays or failure to provide services where this is caused by circumstances beyond reasonable control, such as serious illness, extreme weather, technical failures, emergencies or other events that make delivery impossible or unreasonable.
Where possible, the Practitioner/Coach will communicate with the Client and arrange an alternative date or an appropriate solution.
17. Complaints
If the Client has a concern about the services, the Client is encouraged to contact the Practitioner/Coach directly at info@joyces-hearth.com so that the matter can be addressed constructively.
This does not affect any statutory rights or formal complaint options available to the Client.
18. Governing law
These terms are governed by the laws of Ireland.
Where the Client is a consumer living in another country, this choice of law does not remove any mandatory consumer protections that apply to the Client under the laws of their country of residence.
Any applicable rules concerning jurisdiction and consumer rights remain in force.
19. Changes to these terms
The Practitioner/Coach may update these General Terms & Conditions from time to time.
The version applicable to the Client's engagement will be the version in force when the Client enters into the relevant agreement, unless a change is required by law or otherwise agreed with the Client.
Any changes will not retrospectively affect the Client's existing rights.
